Digital Privacy Policy

I. Summary

This Digital Privacy Policy applies to information collected or submitted online through our California Casualty website and social properties (“our California Casualty websites”). We have established strict standards to maintain the privacy and security of information we collect over the Internet.

California residents have certain privacy rights detailed in our California Consumer Privacy Notice here. To the extent that there is a conflict between this Online Privacy Policy and the California Consumer Privacy Notice, the California Consumer Privacy Notice will control.

To the extent that there is a conflict between this Digital Privacy Policy and the Notice of Insurance Practices, the Notice of Insurance Practices will control. In addition to internet privacy and security, California Casualty Management Company and the California Casualty Group insurance companies (“California Casualty” “we”, or “us” or “our”) are also committed to general consumer privacy and security. We may collect Personally Identifiable Information directly from you with your knowledge and consent.
We use this Personally Identifiable Information to provide you with insurance quotes and to service your insurance policy.
We do not sell your Personally Identifiable Information to third parties.
We only share your information when we are permitted or required by law.
We take reasonable measures to protect your Personally Identifiable Information with physical and electronic safeguards.
We restrict access to and sharing of your Personally Identifiable Information within California Casualty Management Company to those persons who provide services and products to you. Those with access are required to keep your information confidential and must follow strict protocols.

II. Information We Collect

“Personally Identifiable Information” or “PII” means information collected on our California Casualty websites that identifies you personally, such as your first and last name, email address, phone number, address, and full payment account number and can be retrieved and associated with you specifically during the ordinary course of business. We may also collect demographic information, such as your gender, age, zip code, interests, and fire district (“Demographic Information”). Except to the extent required by applicable law, Demographic Information is “non-Personally Identifiable Information” or “non-PII” (i.e., data that is not Personally Identifiable Information under this Online Privacy Policy). In addition, Personally Identifiable Information, once “De-identified” (i.e., the removal or modification of the personally identifiable elements, or the extraction of non-personally identifiable elements including through anonymization, pseudonymization, and/or hashing) is also non-Personally Identifiable Information and may be used and shared without obligation to you, except as prohibited by applicable law. However, we do not make assurances that De-identified data is not capable of re-identification. The definition of “personal information” under certain California laws differs from the definition of PII used in this Digital Privacy Policy. We may collect PII on our California Casualty websites from you if you ask to receive a policy quote, request a policy change, pay a bill, process a claim, or send us feedback. We may collect PII about you, other drivers in your household, your vehicles, and your home to provide a basis for underwriting, rating, servicing, adjusting claims, and collecting premium for California Casualty insurance.

Examples of types of information that we may collect online for both auto and property insurance include:

Applicant name, address, home and work phone, fax, email address
Social Security Number
Information about your current insurance
Types of coverages and limits desired
Credit card number, bank account number, payroll number (depending upon the payment plan you select)

Examples of types of additional information that we may collect online for auto insurance include:

Names of other drivers in household
Driver information for applicant and household members, including:
- Gender, marital status, birth date
- Occupation, employer, year hired, trade association membership
- Driver’s license number/state, licensing dates
- Accidents/claims/moving violations
- Existence of prior insurance coverage

Examples of types of additional information that we may collect online for property insurance include:

Property information, including:
- Property address
- County
- Fire district
- Distance to fire hydrant/fire station

With respect to this information we collect, to the extent any non-PII is combined by us with PII, we will treat the combined data as PII under this Digital Privacy Policy.

III. What We Do With Your Information

We may use your Personally Identifiable Information, for any purposes not inconsistent with our statements under this Digital Privacy Policy, or otherwise made by us in writing at the point of collection, including, without limitation, the following:

Allow you to participate in the features we offer on our websites;
Facilitate, manage, personalize, and improve your online experience;
Process your registration and/or manage your account;
Transact with you, provide services or information you request, respond to your comments, questions and requests, serve you content and/or advertising, and send you notices;
Improve California Casualty websites and for any other internal business purposes;
Tailor our content, advertisements, and offers;
Fulfill other purposes disclosed at the time you provide Personally Identifiable Information or otherwise where we are legally permitted or are required to do so; and
Prevent and address fraud, breach of policies or terms, and threats or harm.

IV. Information We Share with Third Parties

We only share your personal information with others when we are permitted or required by law to do so. Depending upon the circumstances, we may disclose some or all of the information listed in the Information We Collect section above. We do not sell your Personally Identifiable Information.

We are permitted by law to make certain disclosures without your prior authorization, such as:

Sharing your information with our related companies and with unrelated third parties for our everyday business purposes. This sharing of information helps us sell, underwrite and renew policies, prevent insurance fraud, collect premiums, verify group membership, and handle claims. For example, when you make an auto claim, we will share your name and other required information with the shop that repairs your car. Information we obtain from, or provide to, an insurance support organization may be retained by that organization and disclosed to others.

We may also share any information about you for any purposes not inconsistent with this Digital Privacy Policy, or our written statements at the point of collection, and otherwise not prohibited by applicable law, including, without limitation:

California Casualty’s agents, vendors, consultants, and other service providers (collectively “Service Providers”) may receive, or be given access to, your information, including, without limitation, Personally Identifiable Information and Demographic Information, in connection with their work on our behalf.
To comply with the law, law enforcement or other legal process, such as in response to a valid subpoena or other judicial order, and where permitted, in response to a government request. For example, from time to time we must share your information with various state Departments of Insurance and other government agencies.
If California Casualty believes your actions are inconsistent with California Casualty’s terms of use, user agreements, applicable terms or policies, or to protect the rights, property, life, health, security, and safety of California Casualty, the websites or its users, or any third party.

Nevada Residents

Although we do not “sell” “covered information” of Nevada “consumers” as those terms are defined by Chapter 603A of the Nevada Revised Statutes, you may contact us here and register an e-mail contact address for us to provide you notice in the event we should do so in the future, at which point you will have an opportunity to be verified and exercise your opt-out rights under that law. Contact us in the same manner to update your contact email for notices. Changing your email elsewhere (e.g., informational requests, account information, etc.) will not update your Nevada notice contact information. It is your responsibility to keep your notice contact information current.

VI. Children’s Privacy

Our websites, products, and services are all directed to people who are at least 13 years old or older. They are not directed to children less than 13 years of age. We do not intend to collect personal information as defined by the U.S. Children’s Online Privacy Protection Act (“COPPA”) (“Children’s Personal Information”) in a manner that is not permitted by COPPA. If we obtain knowledge that we have collected Children’s Personal Information in a manner not permitted by COPPA, we will remove such data to the extent required by COPPA.

VII. Third-Party Content, Third-Party Services, and Social Features

The California Casualty websites may include or link to third-party websites, apps, locations, platforms, code (e.g., plug-ins, application programming interfaces (“API”), and software development kits (“SDKs”) or other services (“Third-Party Service(s)”). These Third-Party Services may use their own cookies, web beacons, and other Tracking Technologies (defined below) to independently collect information about you and may solicit Personally Identifiable Information from you.

Certain functionalities on the Service permit interactions that you initiate between the California Casualty websites and certain Third-Party Services, such as third party social networks (“Social Features”). Examples of Social Features include: enabling you to send content such as contacts and photos between the Service and a Third-Party Service; “liking” or “sharing” California Casualty’s content; logging in to the California Casualty websites using your Third-Party Service account (e.g., using Facebook Connect to sign-in to the Service); and to otherwise connect the Service to a Third-Party Service (e.g., to pull or push information to or from the Service). Also, both we and the third party may have access to certain information about you and your use of the California Casualty websites and any Third-Party Service.

We are not responsible for, and make no representations regarding, the policies or business practices of any third parties, including, without limitation and encourage you to familiarize yourself with and consult their privacy policies and terms of use.

VIII. Internet Practices

Tracking Technologies

We may use cookies, web beacons, and other tracking technologies (“Tracking Technologies”) on our websites. Many commercial Internet sites use cookies; a cookie enables the site to identify you as a particular user, but it does not identify you by name or address unless you have provided us with such information (over the Internet or otherwise) or set up preferences in your browser to do so automatically. Cookies allow us to provide you with a more customized service and are used to track and measure website usage. This information may be used to manage and customize our website’s content, layout, and services in order to improve our site, enhance customer service, and provide tailored messages. We may also use web beacons, provided by third-party advertising companies, on both our website and on other websites, to help manage and optimize our online advertising. Web beacons enable us to recognize a browser’s cookie when a browser visits our California Casualty websites, to learn which banner ads bring users to our websites, and enable us to deliver more relevant ads to users. Some information about your use of our California Casualty websites and certain third-party services may be collected using Tracking Technologies across time and services and used by us and third parties for purposes such as to associate different devices you use and deliver relevant ads and/or other content to you on our California Casualty websites and certain third-party services.

Advertising and Analytics

We may engage and work with third-party advertising companies to deliver advertisements in search results and on certain websites and mobile apps. Third-party advertising technology may use information derived from your visits to the California Casualty websites and the websites on which we advertise to present ads to you tailored to your interests and uses cookies to track activity (“Interest-based Advertising”). We may use Microsoft and Google for advertising services. See the section below titled “Choices: Tracking Options” for more information on your choices regarding certain personalized advertising.

We may use Google Analytics, or other Service Providers for analytics services. These analytics services may use cookies and other Tracking Technologies to help us analyze website users and how they use the websites. Information generated by these services (e.g., your IP address and other usage information) may be transmitted to and stored by these Service Providers on servers in the U.S. (or elsewhere) and these Service Providers may use this information for purposes such as evaluating your use of the websites, compiling statistic reports on the websites’ activity, and providing other services relating to website activity and other Internet usage. We are not responsible for, and make no representations regarding, the policies or business practices of any third parties, including, without limitation, analytics Service Providers and Third-Party Services associated with the websites, and encourage you to familiarize yourself with and consult their privacy policies and terms of use.

IX. Choices: Tracking Options

Tracking Technologies Generally

Regular cookies may generally be disabled or removed by tools available as part of most commercial browsers, and in some instances blocked in the future by selecting certain settings. Browsers offer different functionalities and options, so you may need to set them separately. However, rejecting cookies may prevent you from using certain functions and you may have to repeatedly enter information to take advantage of services or promotions. Your browser settings may allow you to automatically transmit a “Do Not Track” signal to online services you visit. Note, however, there is no consensus among industry participants as to what “Do Not Track” means in this context. Like many online services, California Casualty currently does not alter our practices when we receive a “Do Not Track” signal from a visitor’s browser.

To find out more about “Do Not Track,” you can visit http://www.allaboutdnt.com, but we are not responsible for the completeness or accuracy of this third party information. Some third parties, however, may offer you choices regarding their Tracking Technologies. One way to potentially identify cookies on our California Casualty websites is to add the free Ghostery plug-in to your browser (www.ghostery.com), which according to Ghostery will display for you traditional, browser-based cookies associated with the websites you visit and privacy and opt-out policies and options of the parties operating those cookies. We are not responsible for the completeness or accuracy of this tool or third-party choice notices or mechanisms.

Analytics and Advertising Tracking Technologies

You may choose whether to receive some Interest-based Advertising by submitting opt-outs. Some of the advertisers and Service Providers that perform advertising-related services for us and third parties may participate in the Digital Advertising Alliance’s (“DAA”) Self-Regulatory Program for Online Behavioral Advertising. Some of these companies may also be members of the Network Advertising Initiative (“NAI”). Please be aware that, even if you are able to opt out of certain kinds of Interest-based Advertising, you may continue to receive other types of ads. Opting out only means that those selected members should no longer deliver certain Interest-based Advertising to you but does not mean you will no longer receive any targeted content and/or ads (e.g., from other ad networks). California Casualty supports the ad industry’s Self-regulatory Principles for Online Behavioral Advertising (PDF) and expects that ad networks we directly engage to serve you Interest-based Advertising will do so as well, though we cannot guaranty their compliance.

You may exercise choices regarding the use of cookies from Adobe Analytics by going to http://www.adobe.com/privacy/opt-out.html under the section labeled “Tell our customers not to measure your use of their web sites or tailor their online ads for you.”

Also, if your browsers are configured to reject cookies when you visit these opt-out webpages, or you subsequently erase your cookies, use a different device or web browser or use a non-browser-based method of access (e.g., mobile app), your browser-based opt-out may not, or may no longer, be effective. We are not responsible for effectiveness of, or compliance with, any third-parties’ opt-out options or programs or the accuracy of their statements regarding their programs.

X. Data Security and Monitoring

We take reasonable measures to protect the PII we collect from you from unauthorized access, disclosure, alteration, and destruction. To maintain data security, and ensure the correct use of information, we put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online. Nevertheless, transmission via the Internet and online digital storage are not completely secure and we do not guarantee the security of your information collected through the California Casualty websites.

To help protect you and others, we may (but make no commitment to) monitor use of the websites, and may collect and use related PII for all purposes not prohibited by applicable law or inconsistent with this Digital Privacy Policy, including, without limitation, to identify fraudulent activities and transactions; prevent abuse of, and investigate and/or seek prosecution for, any potential threats to or misuse of the Service; ensure compliance with the Terms of Use and this Digital Privacy Policy; investigate violations of or enforce these documents; improve the website and your website experiences, and to protect the rights and property of California Casualty, third parties, and other users. Monitoring may result in the collection, recording, and analysis of online activity or communications through our websites. If you do not consent to these conditions, you must discontinue your use of the websites.

In order to help protect against spam and abuse on our website, we use Google reCAPTCHA on our contact forms. Google reCAPTCHA determines whether information entered on a contact form is entered by an actual person or an automated program. This service requires the IP address of the device being used to access the contact form (your computer or mobile device) and possibly other data needed by Google for the reCAPTCHA service. We do not have access to the data Google requires for this service.

XI. Communications

California Casualty respects your privacy. You can opt out of receiving certain promotional communications (emails or text messaging) from us at any time by (i) for promotional e-mails, following the instructions provided in emails to click on the unsubscribe link, or if available by changing your communication preferences by logging onto your account; and (ii) for text messages, following the instructions provided in text messages from us to text the word, “STOP”. Please note that your opt out is limited to the e-mail address or phone number used and will not affect subsequent subscriptions. If you opt out of only certain communications, other subscription communications may continue. Even if you opt out of receiving promotional communications, we may, subject to applicable law, continue to send you non-promotional communications, such as those about your account, transactions, servicing, or our ongoing business relations. When you submit information in connection with this program, you agree that you provide accurate, complete, and true information. In addition, you agree not to use any false or misleading information. If we, in our sole discretion, believe that any information is untrue, inaccurate, or incomplete, we may refuse you access to our SMS texting program.

XII. Access or Correct Your Information

You can access your Personally Identifiable Information that we collect and maintain online by calling our privacy team at 1.800.542.9390. You can request that factual errors in your Personally Identifiable Information be corrected by sending us a request that shows the factual error. You may call our privacy team at 1.800.542.9390 with your request. To protect your privacy and security, we will take reasonable steps to verify your identity before granting access or making corrections.
